Your online privacy is important to Art Licensing International, LLC (“Art Licensing”). As a requirement for use of our website we obtain certain types of information about our users. The following describes this information, what we do with it, and how to correct or change the information if you would like to do so.

 SCOPE OF THIS PRIVACY POLICY

This privacy policy applies to the services, website and/or content made available by Art Licensing and its third party service providers and/or partners (collectively the “Service”, “we”, and “us”).  By using the Service you are consenting to collection and use of your information as outlined in this privacy policy, as well as to our Terms of Use.  

INFORMATION COLLECTED 

Art Licensing collects two types of information from users: personal data (such as names and e-mail addresses) (“Personal Data”); and aggregated information (how many users log into the Service on a regular basis daily, weekly etc.) 

Personal Data

Personal Data is collected through the registration process and use of the Service.  Personal Data may include identifying information, such as name and email addresses, employer, phone numbers, home and/or business address, that will be used to generate your user profile.  To process payments and/or shipping of products we collect and use your payment and shipping information.  This can include your name, your address, your telephone number, your email address, your credit or debit card information, and any other relevant information.

Aggregated Information 

Aggregated Information is collected through various methods: it may come from Service registrations, IP addresses, and your interactions with the Service. Aggregated Information may include but not be limited to age, gender, race, household income, and other information.  We collect this information to help us personalize your experience with the Service by tailoring our content to your specific interests, as well as for us to better understand who uses our Service and to improve the Service accordingly.  

An IP address is a number that is automatically assigned to your computer whenever you’re surfing the web.  We collect IP addresses for the purposes of system administration and to provide aggregate data for customization. Art Licensing does not link IP addresses to any personally identifiable information. Although your session on the Service will be logged through your username, this process will serve to track your session information, and collect Aggregated Information. If this Aggregated Information is published or transferred to any other person (other than your employer or sponsor of your use of the Service as applicable), it will be in an anonymous format. Aggregated Information may also include user IP addresses, device types, and other anonymous statistical data involving the use of the Service. 

USE OF DATA 

In connection with the Service, we may collect data related to users, including but not limited to the names, email addresses, demographic information, or other material submitted by users as further described above (collectively the “Service Data”).  All Service Data shall be the sole property of Art Licensing.  Without limiting the foregoing, we may distribute, sell, license and otherwise use Service Data in aggregate form only (so that no user is personally identifiable) for services provided by Art Licensing to its partners, licensors, and other purposes.

We may use your Personal Data to: provide the service or product requested; for billing and shipping purposes; to provide you with information or promotional materials, including information about new features and enhancements, special offers and other events and items of interest; for the development of new products and services; to improve our website; and, for systems administration and troubleshooting purposes. We agree that we will not disclose to third parties (other than your employer if you are accessing the Service through your employer) the following information: user names, user email addresses, physical addresses, without your consent.  Notwithstanding the foregoing, we cooperate with government and law enforcement officials to enforce and comply with the law. We may therefore disclose personal information, usage data, message data, and any other information about you, if we reasonably deem that it is necessary to: (a) satisfy any applicable law, regulation, legal process (such as a subpoena or court order), or enforceable governmental request; (b) enforce the Terms of Use, including investigation of potential violations thereof; (c) detect, prevent, or otherwise address fraud, security or technical issues; or (d) protect against harm to the rights, property or safety of Art Licensing, its users or the public, as required or permitted by law.

As time passes, Art Licensing may be sold along with its assets, or other transactions may occur in which user data (including but not limited to Personal Data) is one of the business assets transferred. In such a case, the user data which we have gathered may be one of the business assets we transfer.

USE OF COOKIES

The Service does use cookies in a limited manner. A cookie is a small data file that most major websites write to your hard drive for record-keeping purposes when you visit them. Cookies allow measurement of activity in connection with the Service and to improve your user experience, for example, by remembering your passwords and viewing preferences, thus allowing you to interact with the Service without re-registering.  

These cookies are not created or used to collect any information (aggregate or personal) about you at any time.  You may occasionally get cookies from other sites, which is standard in the online world. Art Licensing does not control these cookies, and these cookies are not subject to our privacy policies. 

You do not have to accept cookies to use the Art Licensing Service, however, you may not be able to use certain features or access certain areas if you do not accept cookies. 

Although most browsers are initially set to accept cookies, you may reset your browser to notify you when you receive a cookie or to reject cookies generally.

SECURITY

The Service has security measures in place to protect the loss, misuse and alteration of the information under our control.  However, data transmission over the Internet or wireless networks cannot be guaranteed to be completely secure.  Although we are committed to safeguarding your privacy and security, we cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk.  We urge you to keep any password that you establish with us in a safe place and not to divulge it to anyone.  Also, to prevent others from accessing your account (especially if you are using your device or computer in a public place) please log off your account and close your browser window when you have finished visiting the Service.

LINKS TO OTHER SITES

The Service may contain links to other sites, and those sites may not follow the same privacy policies as Art Licensing. For instance, if you click on a hyperlink on the Art Licensing website, this may take you away from www.artlicensing.com and to an entirely different site.  This can include links from advertisers, content providers, and others who may use the Art Licensing logo, brand, and or style as a result of a partnership arrangement. These sites may send their own cookies or other tracking technologies to you, and may collect and use data in ways that we would not. Please note that we are not responsible for the privacy practices of third party websites. We encourage you to be aware of this when you leave the Service and to read the privacy policies of every website or application that collects personally identifiable information from you. The Privacy Policy applies only to the Service.

CHILDREN’S PRIVACY

We are committed to protecting the privacy of children. This Service is intended for users over the age of 13.  We do not knowingly collect or store any personal information about children under the age of 13.

CHANGES TO THIS POLICY

We retain the right to amend this privacy policy.  If we decide to make an important change to our privacy policy, we will post a notification and link on our website so that you can review the updated policy. If at any point we wish to use your personal information in a manner different from that stated at the time it was collected, we will notify you by means of an email and give you the opportunity to indicate whether you consent to the proposed use. 

CALIFORNIA CONSUMER PRIVACY RIGHTS

Effective as of January 1, 2020

If you reside in California, we are required to provide additional information to you about how we use and disclose your information under the California Consumer Privacy Act (“CCPA”), and you may have additional rights with regard to how we use your information as set forth below: 

California Personal Information. As stated above, we collect certain categories and specific pieces of information about individuals that are considered “Personal Information” in California (“CA Personal Information”), specifically: 

  • Personal and Other Identifiers or Characteristics: such as first name and last name, personal or professional contact information, mailing address, telephone number, e-mail address, unique personal identifier, IP, device, and online activity information, age, date of birth, gender, demographics, username and password to our website or services; 
  • Commercial Information: such as payment details, credit card information and purchase or transaction history. 
  • Other. We may collect certain categories of CA Personal Information from you and other third parties as further described above. 

Use of CA Personal Information. Consistent with this Privacy Policy, we may use CA Personal Information for business or commercial purposes as further set forth above. 

CA Personal Information Sold or Disclosed for Business Purposes. In the preceding twelve months, we may have shared CA Personal Information for business purposes, or shared some categories of CA Personal Information in a manner that would constitute a sale under CCPA. 

California Consumer Rights. Subject to certain exceptions, as a California resident, you may have the following rights to your CA Personal Information: 

  1. Access. Request access to your CA Personal Information that we collect, use, disclose, or sell; 
  2. Deletion. Request deletion of your CA Personal Information (please specify in your request the personal information about you that you would like to have deleted, which can be all of your personal information as required by the CCPA); and 
  3. CA Personal Information Sold or Disclosed for Business Purposes. Request information about the CA Personal Information we have “sold” (as defined under CCPA) or disclosed for business purposes within the preceding 12 months. 

To the extent permitted by applicable law, we may be required to retain some of your CA Personal Information and certain CA Personal Information is strictly necessary in order for us to fulfil the purposes described in this Privacy Policy. 

Exercising California Consumer Rights. If you are a California resident and wish to exercise any of these rights, please contact us. When submitting your request, you may be asked to provide certain information, which may include additional proof of identification, so that we can verify your identity and validate the request. We are not responsible for requests that are not sent or submitted properly, or that do not have complete information. Please note that you are limited by law in the number of requests you may submit per year. We will not discriminate against you by offering you different pricing or products, or by providing you with a different level or quality of products, based solely upon you exercising your rights to your CA Personal Information.

Do Not Sell My Personal Information. If we “sell” (as defined by CCPA) your CA Personal Information to a third party, as a California Resident, you have the right to opt-out of the sale of your CA Personal Information. If you wish to exercise this right, please contact us. You may elect to designate an authorized agent to make a request on your behalf, provided they identify that they are contacting us as your agent. They will be required to provide appropriate documentation including written signed authorization by you, proof of your identity, and verification of their identity; or a valid, designated power of attorney as required under the California Probate Code. We may require additional proof of authority or may need to contact you directly to validate the request. If you are under the age of 16, we will not sell your CA Personal Information without proper consent.

GDPR Data Protection Rights

We would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:

The right to access – You have the right to request copies of your personal data. We may charge you a small fee for this service.

The right to rectification – You have the right to request that we correct any information you believe is inaccurate. You also have the right to request that we complete the information you believe is incomplete.

The right to restrict processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.
